Policy & Terms of Service

This policy represents the agreement between Sweet Treats by Kait and Kay, LLC. (“us, “we, “our”) and the Customer (“you", "your", "their", “Parties”, “party”, “individual”, "client")

 

By paying for your order, you agree to this policy and the terms of service. Accordingly, your payment serves as a signature for the agreement of this policy.

 

Invoice, Prices, & Payment Types

  1.  An invoice will be sent to your email for review, including all the details of your order. No changes to the order will be made unless we say otherwise. If you do not agree to any of the previous terms, you are more than welcome to decline the order. Please keep in mind that this policy is strongly enforced at Sweet Treats by Kait and Kay, LLC.

  2.  Prices - All prices are starting at. Custom themes/designs are an additional cost. 

  3.  Payment Types - For Pre-orders/ Custom Orders, payment types that are accepted are Zelle, Cash App, & PayPal. Orders over $500 are only accepted through PayPal.

Deposits

  1.  To secure the order date, all orders require a 50% non-refundable deposit upon receiving your invoice. The remaining balance/ final payment is due 7 days (1 week) before the pick-up/ delivery date. 

  2. The deposit must be paid within 3 days of the invoice being issued; otherwise, the invoice will be canceled.

  3.  Orders are not booked until the deposit is received. This means your date is not secured until the deposit is paid. 

  4. Orders under $100 require a full payment upon receiving your invoice. 

 

Refunds​

  1. The deposit is non-refundable.

  2. If the client wishes to cancel their order, the non-refundable deposit will not be refunded. 

  3. The non-refundable deposit cannot be applied to future dates. If the client wants to reschedule, they will be required to pay a new 50% non-refundable deposit for the new date requested.

  4. Refunds will not be given if the client misunderstands, misinterprets, or fails to read the contract. 

  5. Taste is based on personal preference. Refunds will not be given if the client does not like the taste of the product. 

  6. Colors are not always exact. Sweet Treats by Kait and Kay, LLC. will work hard to provide the client with similar colors to theirs, but refunds will not be given if the colors do not match exactly. 

  7. If the client does not wish to accept the product upon delivery or pick up, there will be no refund given. Unless the product is fully damaged by Sweet Treats by Kait and Kay, LLC.

  8. Once the product is picked up/delivered, it is no longer Sweet Treats by Kait and Kay, LLC. Responsibility. There will be no refunds for any direct, indirect, incidental, special, consequential, or punitive damages relating to the order.

  9. Any payments made towards your order will not be refunded. If the client's order is canceled, postponed, or rescheduled, you will be appointed credit on a future invoice only if Sweet Treats by Kait and Kay, LLC. has not started on the order. 

  10. If a refund is required, Sweet Treats by Kait and Kay will refund the money within 14 business days after the event date.

Final Payment

  1.  Final payment/ Remaining balance is due 7 days (1 week)  before the pick-up/delivery date. If not paid, your order will not be available for pick-up/delivery.

Obligations​

  1.  Once the item is picked up/delivered, it is no longer Sweet Treats by Kait and Kay, LLC. Responsibility. We will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages relating to the order.

Picking Up/ Delivery

  1.  During your order, the time/pick-up or delivery date will be scheduled. This is a tentative time. We have the right to change the time or pick-up/delivery date for your order.

  2. Pick-up/ Delivery orders must be paid in full 7 days (1 week) before the pick up/ delivery. Sweet Treats by Kait and Kay, LLC. will not provide you order. 

  3. Delivery fees are based on time and distance, with a minimum fee of $15. 

  4. If the delivery location agreed on has changed. This must be explained to Sweet Treats by Kait and Kay, LLC., to ensure the adjustment can be made. An additional fee may be incurred at the client's expense. 

  5. If the client does not wish to accept the product upon delivery or pick up, there will be no refund given. Unless the product is fully damaged by Sweet Treats by Kait and Kay, LLC. 

  6. If a refund is required, Sweet Treats by Kait and Kay will refund the money within 14 business days after the event date.

  7. The client will assume all the responsibility for any damage to the product once the product leaves Sweet Treats by Kait and Kay, LLC. Possession. Sweet Treats by Kait and Kay, LLC. Assumes no responsibility for the damages incurred during self-pickup or after delivery. 

  8. The pick-up address is located in the invoice.

Fees

  1.  Orders with less than 10 days’ notice are subject to a $20 rush order fee. 

  2. ​ LATE PICKUP FEES: A late fee of $15 will be charged for any order not picked up within (15) minutes of the scheduled time. Each additional (15) minutes will incur an additional $15. This fee must be paid by cash, cash app, or Zelle before your order is released to you.

    • 0-14 minutes $0​

    • 15-29 minutes $15

    • 29-44 minutes $30

    • 45-60 minutes $45

    • Pick-ups after the one-hour window are/will not be available. 

  3. Accommodations can be made in extreme cases but are not guaranteed, and may be politely declined.

  4.  FREE delivery on orders over $500 up to 15 miles from our kitchen.

  5.  Delivery fees are based on time and distance, with a minimum fee of $15.

Sickness​

  1.  You acknowledge that Sweet Treats by Kait and Kay, LLC. has the right to cancel any order in the event they become ill or have a family emergency. The client will be contacted and informed. In addition, the client will be subject to a refund ONLY in such circumstances.

Allergies

  1.  All orders are prepared in a kitchen that may contain known food allergies, such as but not limited to: milk, soy, gluten, nuts, eggs, and wheat. Please advise of allergens prior so we can accommodate them
